Recently, I\u2019ve had the misfortune – along with several business associates – of receiving <\/span>cold emails<\/span>. Now, I\u2019m all about reaching out to your target customers – I\u2019ve built a whole business around it! But I always advise my clients to stick within the boundaries of the very clear <\/span>email marketing laws.<\/b><\/p>\n

Email marketing laws<\/span> aren\u2019t the most exhilarating topic. I know anything to do with the <\/span>rules of GDPR<\/span> or <\/span>cold emails<\/span> is often met with an eye roll and people zone out. Bear with me – because it\u2019s REALLY vital that you understand them, at least at a basic level.\u00a0<\/span><\/p>\n

In this blog, we look at <\/span>cold emails<\/span>, the legal boundaries of email marketing, <\/span>GDPR in the UK<\/span> (and other countries), the consequences of noncompliance and how we can <\/span>stay on the right side of the law.<\/b><\/p>\n

What are cold emails and are they illegal?<\/h2>\n

Cold emails<\/span> are unsolicited emails sent to someone who has not previously expressed an interest in receiving emails from the sender or their business. <\/span>Cold emails<\/span> are typically used for marketing purposes, such as promoting a product or service, or for networking purposes, such as seeking new business opportunities.<\/span><\/p>\n

Cold emails <\/span>are a massive nuisance to most people but they are not inherently illegal – to a certain degree. The <\/span>legality of<\/span> cold emails<\/span><\/a><\/span><\/span> depends on the specific laws and regulations in the country where the email is sent. In general, most countries require businesses to obtain the recipient’s prior consent before sending them marketing emails.\u00a0<\/span><\/p>\n

As we will see later, <\/span>cold emails <\/span>aren\u2019t always illegal, but sending them without proper consent or in violation of the applicable laws can result in penalties, fines and damage to a business’s reputation.<\/span><\/p>\n

What is GDPR in the UK?<\/h2>\n

GDPR in the UK<\/span> is General Data Protection Regulation. It\u2019s a set of regulations that govern the way personal data is collected, processed, stored, and shared by organisations operating within the EU – including the UK.\u00a0<\/span><\/p>\n

Under the <\/span>rules of GDPR<\/span>, personal data is defined as any information relating to personal identification, such as a name, address, email address, or IP address.<\/span><\/p>\n
